Terms of delivery and return

  1. DELIVERY CONDITIONS

1.1 These Terms and Conditions of Sale and Purchase of Goods (hereinafter referred to as the "Terms and Conditions"), once approved by the Buyer (by ticking the box indicating that you accept the Terms and Conditions of "www.cityboxing.lt"), shall be a legal document binding on the parties, which shall determine the rights and obligations of the Buyer and the Seller, the terms and conditions of purchase of the goods and the conditions of payment for the goods, the procedure for delivery of the goods and the procedure of return of the goods, the parties' liability, and any other provisions relating to the purchase and sale of goods in the "wwwcityboxing..lt" online store (hereinafter referred to as the "Shop").

1.2 The Seller reserves the right to change, amend or supplement the Terms and Conditions at any time, taking into account the statutory requirements. 

  1. PERSONAL DATA PROTECTION
  • Any information relating to personal data that is recorded in the Shop shall be considered confidential and non-public.
  1. RIGHTS OF THE PURCHASER

3.1 The Buyer shall have the right to purchase Goods in the Shop in accordance with these Terms and Conditions.

3.2 The Buyer shall have the right to withdraw from the contract for the purchase and sale of goods concluded with the Seller by notifying the Seller in writing (by e-mail, indicating the product to be returned and its order number) not later than within 14 (fourteen) days from the date of conclusion of this contract.

3.3 The Buyer may exercise the right provided for in Clause 3.2 only if the goods have not been damaged by the Buyer or substantially altered in appearance or used.

3.4 The Buyer shall comply with other requirements set out in the Rules and the legislation of the Republic of Lithuania.

  1. BUYER'S OBLIGATIONS
  • The Buyer shall pay for and accept the Goods in accordance with these Conditions.
  1. SELLER'S RIGHTS

5.1 If the Buyer attempts to undermine the stability and security of the operation of the Shop or violates his/her obligations, the Seller shall have the right to restrict or suspend the Buyer's access to the Shop or, in exceptional cases, to cancel the Buyer's registration, immediately and without notice.

5.2 The Seller shall have the right to cancel the Buyer's order without prior notice to the Buyer if the Buyer fails to pay for the Goods within one (1) working day.

  1. SELLER'S OBLIGATIONS

6.1 The Seller undertakes to respect the Buyer's right to privacy with regard to his/her personal information provided in the Shop registration form and not to disclose the obtained data to third parties, except for the cases stipulated by the legislation of the Republic of Lithuania.

6.2 The Seller undertakes to deliver the Goods ordered by the Buyer to the address specified by the Buyer in accordance with the terms and conditions set out in Clause 8 of the Rules.

6.3 If the Seller is unable to deliver the goods ordered to the Buyer due to important circumstances, the Seller undertakes to offer an analogous product or a product that is as similar as possible in terms of its characteristics. If the Buyer refuses to accept an analogous or most similar product, the Seller undertakes to refund the money paid by the Buyer within 3 (three) working days, if prepayment has been made.

  1. PRICES, PAYMENT PROCEDURES AND TERMS

7.1 The prices of the goods in the Shop and in the order shall be quoted in euros including VAT.

7.2 The Buyer shall pay for the Goods in one of the following ways:

7.2.1. payment by electronic banking means prepayment through the electronic banking system used by the Buyer. In order to use this form of payment, the Buyer must have signed an e-banking agreement with one of the banks listed on our website. When paying for the goods in this way, the Buyer's e-banking system generates a payment according to the order he/she is paying for. The Buyer also has the option to pay by bank card. In this case, the responsibility for data security rests with the respective bank, as all monetary transactions take place in the bank's electronic banking system. Bank payments in the Shop are made through the Pysera electronic payment system.

7.3 The Buyer undertakes to pay before collecting the goods. In the aforementioned cases, it is only upon receipt of payment for the Goods that the consignment of Goods shall be formed and the delivery period shall begin to run.

  1. DELIVERY OF GOODS

8.1 When ordering the Goods, the Buyer undertakes to specify the place of delivery of the Goods and a contact telephone number.

8.2 The Buyer undertakes to accept the Goods himself. In the event that the Buyer is unable to take delivery of the Goods himself and the Goods have been delivered to the address indicated and on the basis of other data provided by the Buyer, the Buyer shall not be entitled to make any claim against the Seller in respect of the delivery of the Goods to the wrong entity.

8.3 The Goods shall be delivered by the Seller or its authorised representative (postal or courier service).

8.4 The Seller undertakes to deliver the Goods to the Buyer in accordance with the terms specified in the descriptions of the Goods. These time limits shall not apply in cases where the Seller's warehouse does not have the goods required and the Buyer is informed of a shortage of the goods ordered. The Buyer also agrees that in exceptional circumstances the delivery of the goods may be delayed due to unforeseen circumstances beyond the Seller's control. In such a case, the Seller undertakes to contact the Buyer immediately to agree on the delivery of the goods.

8.5 In all cases, the Seller shall be exempt from liability for breach of the time limit for delivery of the Goods if the Goods are not delivered to the Buyer or are not delivered on time due to the Buyer's fault or due to circumstances beyond the Buyer's control.

8.6 At the time of delivery of the Goods, the Buyer shall inspect the condition of the consignment with the Seller or its authorised representative. Once the Buyer has signed the invoice (bill of lading) or any other document of delivery and acceptance of the consignment, the consignment shall be deemed to have been delivered in good condition.

8.9 Collection of the Goods may also be made at City Boxing's registered office at Kalvarijų g. 143, Vilnius.

Rules for returning goods

Returning and exchanging goods and services. 

1.1 Returns of goods and services shall be made in accordance with the laws of the Republic of Lithuania. 

1.2 The Buyer must send the returned goods by registered mail. The registered consignment number must be provided to the Seller no later than 24 hours after dispatch. The payment made after the purchase of a gym membership will only be refunded if the Buyer has not made any visits.

1.3 If the Buyer wishes to return the faulty product(s), the Buyer may do so within 14 days from the date of delivery of the goods to the Buyer by informing the Seller by email, attaching photos or a video of the product and/or parcel describing the problem. 

1.4 In the event of a return of a product that is not the same as the product received, the Seller undertakes to replace the product with the correct product. In the absence of the required item, the Buyer shall receive a full refund (for the item plus actual shipping costs incurred). 

1.5 Where a faulty product is returned, the Seller undertakes to replace the faulty product with an equivalent product or to refund the Buyer. 

1.6 The Seller shall have the right not to accept the Buyer's return of the Goods if the Goods(s) were delivered in good quality or the packaging of the Goods(s) has been opened. 

1.7 The Seller shall have the right not to accept the Buyer's returns if the Buyer does not comply with the return procedure set out in these Terms and Conditions. 

1.8 If the Buyer paid for the product with a gift voucher, the voucher and any additional amount paid (if any) shall be refunded. 

1.9 If the Buyer returns an item purchased at a discount, the amount paid for the item shall be refunded together with the applicable discount. 

Return of quality goods 

The return of quality goods shall be carried out in accordance with the Civil Code of the Republic of Lithuania and the Resolution of the Government of the Republic of Lithuania (2014-07-22) on the Approval of the Rules of Retail Trade and the Rules of Retail Trade themselves, the provisions of Article 6.228(1) of the Civil Code of the Republic of Lithuania ("The consumer shall be entitled to withdraw from the distance contract or the off-premises contract, except for the exceptions provided for in Paragraph (2) of this Article, within fourteen days, without giving any reasons and without bearing any costs other than those set out in Article 6.22811 of the present Code, without giving any reason other than those set out in Article 6.22811 of the present Code". In the event that the Consumer concludes a contract of sale (hereinafter referred to as the Contract) by means of communication only (distance contract) and is therefore unable to exercise the statutory right to inspect the goods and assess their suitability prior to the conclusion of the Contract, the Consumer shall have the right to withdraw from the Contract of sale by notifying the Seller in writing within fourteen (14) days from the date of delivery. If the Buyer has purchased several Goods under one Contract, the Buyer shall have the right to withdraw from all the Goods purchased under one Contract or from only some of the Goods purchased under one Contract. The period of 14 (fourteen) days for the written request shall start to run from the date of delivery of the goods(s) to the Buyer or his authorised representative and shall not be extended or in any way linked to the transfer or return of the goods to the Seller or to any other person for reasons beyond the control of the Seller. 

You can return quality goods within 14 days if: 

 

  • the returned product is in its original, clean packaging; 
  • the product is unused and undamaged; 
  • the product is in good condition (labels intact, protective films, bags, etc.); 
  • the returned product is in full working order with all the documentation supplied by the manufacturer; 
  • When returning the product, you must present the document of purchase and the warranty card (if issued). 
  • Please send the returned product to the following address of the headquarters of UAB Boksas visiems, Kalvarijų g., 143 Vilnius. 

 When returning quality goods, the buyer is responsible for: 

  • packaging of goods 
  • return of the goods by registered mail to our address above 
  • We may refuse to take back an item if there have been changes to the appearance of the item or packaging that were not necessary to inspect the item, including damaged labels, torn protective films and damage to transparent packaging that would not prevent you from exercising your right to inspect the goods.

If damage to the packaging of the goods means that the goods cannot be subsequently disposed of at the same price, without prejudice to the rights of the other Buyer of the goods to purchase new and unused goods, such goods may only be returned by mutual agreement (e.g. if you have agreed to compensate for the difference in the depreciation of the goods).

When returning an e-shop purchase, we will ask you to submit a free-form written request with detailed order information: order number, date, product, price, delivery date. If you were given an additional discount on your order at the time of purchase, and you have returned only part of the goods purchased in one order, we may deduct the amount of the discount from the refund. 

When returning quality goods, the Buyer shall bear the full cost of transport for their return. 

Returns made after purchase in the City Boxing physical store shall be made in accordance with the above mentioned conditions of 22 July 2014. The Rules of Retail Trade of the Republic of Lithuania (hereinafter referred to as the "Rules"), approved by Government Resolution No. 738 of 2014. 

Returning a product if you have purchased a faulty product 

Returns in case of defective goods and in other cases, in accordance with the Civil Code of the Republic of Lithuania (Article 6.363(7)) and the Government Resolution of the Republic of Lithuania (2014-07-22) on the approval of the Retail Trade Rules and the Retail Trade Rules themselves. In the event that the reason for returning the goods is the purchase of goods of inadequate quality, we shall be obliged to replace the goods of inadequate quality with goods of adequate quality at our own expense or to reimburse the money paid for the goods, where the goods are of an inadequate quality due to the fault of the manufacturer, i.e. where there are no identified irregularities caused by the buyer's improper use, damages, unreplaced parts, the serial number of the purchased goods is the same as that of the goods to be returned, and the like.
